The description for this item says (Scratch n' Dent) not refurbished. Scratch and dent usually means new items that have been damaged at the warehouse/store or damaged returned items.

If you click on the product page it gives you a description about the condition:

      NOTE:
Due to these being classed as "scratch n' dent", there will be significant scratches and nicks on the back casing of this tablet. These were store display units that were mounted in retails stores so the removal from their wall mounts resulted in heavy scratches on the backs of these tablets.
Due to these cosmetic blemishes, we are selling them well below retail price. The damage is merely external thoughit does not affect the overall tablet performance in any way.
Because the port covers are missing from these 'scratch n dent' Elements, these can no longer be classified as waterproof, as it was the port covers that provided the waterproof protection.

These systems have been refurbished, which means:
      a) They have been fully reset to their initial factory specifications.
      b) They are guaranteed to be in full working condition, just like a new unit.
      c) It ships with the necessary accessories.
d)They come with our full 90 day, no questions asked, replacement warranty.
e)The LCD display is in perfect condition - no marks on the actual display.
      f) NOTE: As above, these are NOT waterproof

So you can likely assume the battery is shot in these since they were plugged into retail charger displays all day.

^ Anything with a built in Li-Ion battery has a smart charge circuit that will keep it from overcharging and degrading the battery... otherwise Li-Ion have a tendency to burst into flames or a 2nd circuit disconnects the battery permanently.

I decided to roll the dice on one of these. It's not the greatest tablet but its an ok tablet. I bought it because of the GSM 4G connectivity and the ease of unlocking so I can use any GSM carrier. I don't plan on using AT&T.
