They might be around. But they suck so bad you'll wish they went out of business.
#2 is correct. They are fu*king garbage. I have been using them for the last year and up until a month ago (fingers crossed) they were going down two to four hours a month (during prime-time hours, no less). Maybe they fixed it (server upgrade, they said, each time, when you could actually get through to them)...But even if they fixed it, it doesn't give me enough peace of mind to recommend them to anyone here. Remember, you get what you pay for.
#2 and #3 should be sued for their litigious comments! Globat is a highly reputable company with excellent customer service! FACT!

#4 should be sued for his "FACTs" and "SMIRKs". now that's a FACT!
These guys were rodeo cowboy to try and do business with.
Any recommendations on ISP's? I've grown tired of Infinity Host (http://www.infinityhost.com/products/compareBudgetVPS.php) and would love to find a MORE RELIABLE, better value, virtual private server. Biggest drivers for me would be >5GB storage and >50GB data transfers.

After trying multiple low-end hosts, you get what you pay for. Customer service usually is terrible. I have had my website turned off with no explanation.
