I had this thing. It's hard to keep it in the air for more than 10 seconds.

And then a few months later the batteries are dead? Isn't that the case with these RC toys?

#2, I don't know. I returned the thing to ToyRUs the next day. I doubt the battery would last few months. This thing in fact should be referred to as "remote controlled toy" rather than "RC (Radio Controlled) toy".
