There are few ways to use the "analog hole" to get premium channel content recorded. This is one of the best. Recording premium TV for personal use is perfectly legal. Building a library of this content is also perfectly legal.
#2 I own the Hauppauge and visit the owner's forum from time to time. There is occasional talk of the loophole closing, but so far so good. I'm sure it's not that hard technically to achieve (probably some variant of scrambling the analog channel and requiring a descrambler on the receiving side) but I'm guessing we're good for at least another year. In the meantime, I'm recording as much HD video as I can.
