Take No. 2's advice and make sure the phone can, indeed, be unlocked; this "deal" is worthless unless you can do that easily and either free or very cheaply.
#2 & #3, this phone can still be EASILY unlocked. Instructions are all over the web for how to do it. I picked one up 2 weeks ago as a spare. Ben's review on this phone is spot on. IMO, it's a great deal if it meets your needs. For most folks, it will.
